Everyone knows that clubs and bars have been charging women lower cover charges and granted shorter waits for decades, but a recent lawsuit claims that the practice is unconstitutional.
Roy Den Hollander, a Manhattan attorney, recently filed a class action suit for "invidious discrimination" against men who entered six specific NYC nightclubs over the past three years. He says he is so fed up that women get to party for less money that he filed a lawsuit demanding the same treatment.
The suit, which still needs to prove state action is required, claims the nightclubs violate the 14th Amendment's guarantee of equal protection under the law.
The nightclubs named in the suit include Copacabana (recently closed), China Club, A.E.R. and SOL.
Hollander is seeking nominal damages and an injunction to halt the nightclubs' practice of admitting women at a lower price than men. He is also seeking to be named class representative for all men overcharged or burdened by stricter time restraints than women at these clubs over the last three years.
"Whether this case succeeds or fails, it will result in a much needed victory for men," Hollander told The National Law Journal.
